Definition of land use planning

According to Clause 2, Article 3 of the 2013 Land Law, the definition is as follows:

“2. Land use planning is the allocation and zoning of land according to the space of use for the goals of socio-economic development, national defense, security, environmental protection and climate change adaptation based on land potential and land use needs of sectors and fields for each socio-economic region and administrative unit within a specified period of time.

Accordingly, land use planning is the process of zoning a specific area of land and using it for a specific socio-economic development, national defense, or security purpose in an administrative unit within a specified period of time.

Pursuant to Clause 1, Article 36 of the 2013 Land Law, amended by Clause 1, Article 6 of the Law on Amendments and Supplements to Laws related to planning 2018, the system of planning and land use plans is regulated as follows:

1. Land use planning includes:

a) National land use planning;

b) District-level land use planning;

c) National defense land use planning;

d) Security land use planning.

Accordingly, land use planning is divided into 4 types: national land use planning; district-level land use planning; national defense land use planning; and security land use planning.

Note: at the provincial level, the plan for land allocation and zoning by functional area and by land type for each district-level administrative unit is a content of the provincial planning.
