Can foreigners buy land in Vietnam?

Can foreigners buy land in Vietnam?

1. Pursuant to the 2013 Land Law, subjects allowed to own land in Vietnam include:

 - Domestic organizations include state agencies, people's armed units, political organizations, socio-political organizations, economic organizations, socio-political-professional organizations, and social organizations , socio-professional organizations, public service organizations and other organizations according to the provisions of civil law (hereinafter collectively referred to as organizations);

 - Domestic households and individuals (hereinafter referred to as households and individuals);

 - Residential community includes the Vietnamese community living in the same village, village, hamlet, village, hamlet, phum, soc, residential groups and similar residential areas with the same customs, practices or in common. lineage;

 - Religious facilities include pagodas, churches, chapels, shrines, cathedrals, Buddhist temples, monasteries, separate religious training schools, headquarters of religious organizations and other religious facilities;

 - Foreign organizations with diplomatic functions include diplomatic representative agencies, consulates, and other foreign representative agencies with diplomatic functions recognized by the Vietnamese Government; representative agency of an organization of the United Nations, intergovernmental agency or organization, representative agency of an intergovernmental organization;

 - Vietnamese people residing abroad;

 - Foreign-invested enterprises include 100% foreign-invested enterprises, joint-venture enterprises, Vietnamese enterprises in which foreign investors buy shares, merge, and acquire;

 Thus, foreigners are not eligible to own land. Therefore, it will not be possible to buy land and put your name on the land use right certificate in Vietnam. However, foreigners can still own houses in Vietnam if they meet the conditions prescribed by the Housing Law.

 2. Conditions for foreigners to own houses in Vietnam

 Pursuant to the 2014 Housing Law, conditions for foreigners to own houses in Vietnam include:

 - Foreign individuals are allowed to enter Vietnam

 - Have a valid passport with an entry verification stamp from the immigration management agency 

 - Not eligible for diplomatic or consular privileges and immunities 

 The home ownership term for foreigners is 50 years and can be extended if needed.

 Thus, although foreigners are not allowed to own land in Vietnam, they can still own houses.
