1. What is a famous trademark?

A famous trademark is a trademark that is popular with the relevant public and is known throughout the territory of Vietnam.

2. Criteria for evaluating famous brands

Consideration and assessment of a famous brand will be selected from some or all of the following criteria:

  • Time of continuous use of the brand;
  • Number of countries protecting trademarks;
  • The number of countries in which the trademark is recognized as famous;
  • Wide reputation of services and goods bearing the mark;
  • The territory in which the services and goods bearing the trademark have been circulated;
  • Transfer price, transfer of rights to use, value of investment capital contribution of the brand;
  • Revenue from the sale of goods or provision of services bearing the mark or the number of services provided, the quantity of goods sold;
  • The number of relevant consumers who know the mark through advertising or through the use, purchase and sale of goods and services bearing the mark.

3. Criteria for evaluating famous brands

Consideration and assessment of a famous brand will be selected from some or all of the following criteria:

4. Conditions for registration of collective trademark protection

To be protected, a collective trademark must meet the following two conditions:

  • Identification signs are seen in the form of words, images, drawings, 3-dimensional images or combinations of such elements in one or more colors;
  • Be able to distinguish the services and goods of the organization that is the owner of the collective mark from other entities that are not members of that organization.
