Levels of administrative penalties for violations of regulations on exit, entry, transit, residence and travel in Vietnam

Administrative penalties for violations of regulations on exit, entry, transit, residence and travel are specified in Article 18. Decree 144/2021/ND-CP include:

- Warning or fine from 300,000 VND to 500,000 VND for foreigners traveling on Vietnamese territory without carrying passports, travel documents, international travel documents, or documents issued to Foreigners entering, exiting, residing in Vietnam or ABTC card.

- Fine from 500,000 VND to 2,000,000 VND for one of the following acts:

+ Failure to notify competent authorities about the loss or damage of passports, laissez-faire documents, or valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

+ Untruthful declaration to obtain, extend, restore validity or report loss of passport or travel document; Making false statements to obtain valid international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

+ Foreigners entering government areas requiring a permit without a permit or traveling beyond the permitted scope and time limit;

+ Do not present passports, laissez-passers, documents valid for international travel, documents issued to foreigners entering, leaving, or residing in Vietnam or ABTC cards when competent agencies or persons Vietnam's requirements; Failure to comply with the requirements of competent Vietnamese agencies and persons on searching people, means of transport, objects, places of hiding evidence, and means of administrative violations;

+ Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not renew permanent residence cards in Vietnam for a period of less than 16 days without permission from a competent authority.

- Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:

+ Crossing national borders without completing exit and entry procedures as prescribed by law;

+ Destroying, erasing, erasing, modifying or falsifying the form and content of passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

+ Giving, giving, renting, leasing, pledging, receiving pledges of passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

+ Allowing others to use passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards to commit acts contrary to the law;

+ Use passports, laissez-passers, and valid international travel documents; Documents issued to foreigners entering, exiting, or residing in Vietnam, or ABTC cards of other people for entry, exit, transit, residence, or to commit other illegal acts;

+ Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not renew permanent residence cards in Vietnam for more than 16 days to less than 30 days without permission from a competent authority;

+ Foreigners who have been issued a permanent residence card but change their address but do not declare to re-issue; Foreigners entering border gate economic zones and coastal economic zones under visa exemption to go to other locations in Vietnam without a Vietnamese visa according to the provisions of law;

+ Tourist accommodation establishments that are hotels do not connect to the internet or computer network with the immigration management agency of the Police of the province or centrally run city to transmit temporary residence declaration information of foreigners. ;

+ Accommodation facilities for foreigners to stay overnight but do not declare temporary residence or do not update temporary residence declaration information according to regulations; Foreigners do not provide or provide false information to accommodation establishments to declare temporary residence according to the provisions of law.

- Fine from 5,000,000 VND to 10,000,000 VND for one of the following acts:

+ Using fake passports, fake travel documents, and valuable international travel documents; fake documents issued to foreigners entering, leaving, or residing in Vietnam or fake ABTC cards;

+ Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not renew permanent residence cards in Vietnam for more than 30 days to less than 60 days without permission from a competent authority.

- Fine from 10,000,000 VND to 15,000,000 VND for one of the following acts:

+ Foreigners enter, practice or engage in other activities in Vietnam without permission from competent Vietnamese authorities;

+ Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not issue permanent residence cards for more than 60 days to less than 90 days without permission from a competent authority;

+ Buy and sell passports, laissez-passers, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards.

- Fine from 15,000,000 VND to 20,000,000 VND for one of the following acts:

+ Carry out invitation and sponsorship procedures for foreigners to enter, exit, and reside in Vietnam but do not fulfill their responsibilities according to the provisions of law or declare untruths when carrying out invitation and sponsorship procedures. for foreigners entering, leaving, and residing in Vietnam;

+ Foreigners entering the country for improper purposes or programs have requested a visa, temporary residence card or extension of temporary residence;

+ Forging documents and records to obtain passports, travel documents, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

+ Foreigners use temporary residence certificates, temporary residence extensions, temporary residence cards, and do not renew permanent residence cards for more than 90 days or more without permission from a competent authority;

+ Agencies and organizations that employ foreigners to work or work but do not carry out procedures for inviting or guaranteeing the issuance of visas or temporary residence cards, except in cases where the purpose is changed according to the provisions of law.

- Fine from 30,000,000 VND to 40,000,000 VND for one of the following acts:

+ Counterfeit passports, travel documents, and valuable international travel documents; Documents issued to foreigners entering, exiting, and residing in Vietnam or ABTC cards;

+ Entering or staying at an embassy, ​​consulate, diplomatic representative agency, consular office or headquarters of an international agency or organization located in Vietnam without permission of that agency or organization;

+ Foreigners residing in areas where foreigners are prohibited from residing;

+ Vehicle owners, vehicle managers, drivers of all types of vehicles transporting people entering or exiting Vietnam illegally;

+ Organizing, brokering, assisting, instigating, harboring, concealing, creating conditions for others to leave, stay abroad, enter, stay in Vietnam or cross national borders illegally.

+ Foreigners who do not comply with the competent authority's decision to force them to leave Vietnam and continue to reside in Vietnam.

- Additional penalties:

+ Confiscate material evidence and means of administrative violations for the acts specified in Points b, c, d, Clause 3; Point a Clause 4; Point a Clause 5; Point c Clause 6; Points a and d, Clause 7, Article 18 Decree 144/2021/ND-CP;

+ Expel foreigners who commit administrative violations specified in Clauses 1, 2, 3, 4, 5, 6 and 7, Article 18 Decree 144/2021/ND-CP.

- Remedial measures:

Forced to return illegal profits obtained from violations specified in Point c, Clause 3 and Points a and c, Clause 5, Article 18 Decree 144/2021/ND-CP.

Note: According to the provisions of Clause 2, Article 4 Decree 144/2021/ND-CP The fine level is specified in Chapter II Decree 144/2021/ND-CP is the level of fine applied to administrative violations of individuals. For organizations that commit the same violation, the fine is 2 times the fine for individuals.
