How much is the penalty for a food service business that provides services at twice the price for foreigners coming to Vietnam to travel?

This article addresses the penalties for dining service businesses that intentionally double prices for foreign tourists in Vietnam. By analyzing current legal regulations, we help you better understand the rights of tourists and the obligations of businesses to ensure fair and reasonable pricing.
The act of providing services at twice the price for foreigners coming to Vietnam for tourism is specified in Point b, Clause 3, Article 6. Decree 45/2019/ND-CP and Clause 9, Article 6 Decree 45/2019/ND-CP as follows:
“Violation of general regulations on tourism business activities:
4. Fine from 3,000,000 VND to 5,000,000 VND for one of the following acts:
a) Failure to promptly notify competent state agencies when detecting accidents or risks or incidents occurring to tourists;
b) Failure to resolve complaints and complaints from tourists within the scope of management;
c) Illegally profiting from tourists.
9. Remedial measures:
Forced to return illegal profits obtained from performing the acts specified in Point a, Clause 3, Point c, Clause 4 of this Article.
Pursuant to Clause 3, Article 5 Decree 45/2019/ND-CP regulations on mThe penalties for fines and authority to impose fines in the tourism sector are as follows:
“1. The maximum fine for each administrative violation in the field of tourism for individuals is 50,000,000 VND, for organizations is 100,000,000 VND.
2. The fines specified in Articles 6, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 18 of this Decree apply to individuals. The fine levels specified in Article 7 of this Decree apply to organizations.
3. For the same administrative violation, the fine for organizations is 2 times the fine for individuals.”
Accordingly, organizations carrying out food service business activities that provide services at twice the price to tourists will be subject to administrative penalties ranging from 6,000,000 VND to 10,000,000 VND.
In addition to the imposition of fines, organizations conducting food service business activities that provide services that cost twice as much to tourists are also subject to remedial measures such as forcing them to pay back any unfavorable profits. Legality is obtained by performing an act.
Note:
For the same administrative violation, the fine for organizations is 2 times the fine for individuals. Therefore, individuals who provide services that cost twice as much to tourists will be subject to an administrative fine of between VND 3,000,000 and VND 5,000,000.
